Terms of Service

These Terms of Service ("Terms") govern access to and use of Talkelier's websites, application, chatbot tooling and channel integrations (the "Service"). By creating an account, connecting a channel or using the Service, you agree to these Terms. If you act for an organization, you represent that you have authority to bind it.

1. Eligibility and accounts

You must have legal capacity to accept these Terms. You must provide accurate account information, protect credentials and promptly report unauthorized access. You are responsible for activity performed through your account and for assigning only appropriate workspace permissions.

2. The Service

Talkelier lets customers create, configure, publish and operate conversational experiences. Features may include web chatbots, workflows, knowledge, analytics and connections to third-party messaging services. Features identified as preview, beta or pilot may change, be limited or be withdrawn.

3. Customer responsibilities

  • Use the Service lawfully and provide all notices and obtain all permissions or consents required for your chatbot and its content.
  • Ensure chatbot instructions, claims, knowledge and automated actions are accurate, appropriate and authorized.
  • Configure retention, access, providers and channel behavior for your use case.
  • Respond to end-user requests and complaints concerning your business and chatbot.
  • Keep provider credentials confidential and immediately revoke or replace credentials believed to be compromised.

4. WhatsApp and third-party services

WhatsApp functionality requires a customer-owned and authorized Meta business account, WhatsApp Business Account and eligible phone number. You are responsible for Meta approval, message templates when required, recipient consent and compliance with WhatsApp Business and messaging policies. Talkelier does not control Meta's review, availability, delivery decisions, pricing or account enforcement.

The Service may interoperate with hosting, identity, AI and other providers. Their terms, privacy practices, limits and charges may apply separately. You authorize Talkelier to exchange the data necessary to provide the integrations you configure.

5. Acceptable use

You may not use the Service to violate law or third-party rights; send spam or deceptive messages; harass, exploit or discriminate; distribute malware; obtain unauthorized access; bypass limits or security controls; impersonate others; process data without required authority; or create content or automated actions that are illegal or foreseeably harmful. You may not reverse engineer or resell the Service except as expressly authorized.

6. Customer data and privacy

You retain your rights in content and data you submit. You grant Talkelier the limited rights needed to host, protect, process, transmit and display that material to operate and improve the Service. You represent that you have the rights and authority required to provide it. Our handling of personal data is described in the Privacy Policy.

7. Talkelier rights

Talkelier and its licensors retain all rights in the Service, software, designs, documentation, trademarks and related technology. These Terms provide a limited, revocable, non-exclusive right to use the Service; they do not transfer ownership.

8. Fees

Creating an account does not by itself create a paid subscription. If paid functionality becomes available, the applicable price, currency, taxes, limits, renewal and cancellation terms will be disclosed before purchase and will form part of these Terms. Third-party provider or messaging charges are your responsibility unless expressly stated otherwise.

9. Availability and changes

We work to keep the Service available and secure, but do not guarantee uninterrupted or error-free operation. We may modify features, limits or integrations to improve the Service, comply with law, protect security or respond to provider changes. We will provide reasonable notice when a material change adversely affects active paid use, where practicable.

10. Suspension and termination

You may stop using the Service at any time and may request account deletion. We may limit or suspend access when reasonably necessary to address security, unlawful activity, policy violations, nonpayment or risk to the Service or others. We may terminate an account for a material or repeated breach. Sections that by their nature should survive termination remain effective.

11. Disclaimers

To the extent permitted by law, the Service is provided "as is" and "as available". Talkelier disclaims implied warranties of merchantability, fitness for a particular purpose and non-infringement. Chatbot and AI-generated output may be incomplete or incorrect and must not replace qualified professional judgment where health, legal, financial, safety or other high-impact decisions are involved.

12. Limitation of liability

To the extent permitted by law, Talkelier will not be liable for indirect, incidental, special, consequential or punitive damages, lost profits, lost revenue, lost data or business interruption arising from the Service or third-party providers. Any liability that cannot legally be excluded remains limited only to the extent permitted by applicable law. Nothing in these Terms excludes rights or liability that cannot lawfully be excluded.

13. Changes, disputes and contact

We may update these Terms and will publish the new effective date. Material changes apply prospectively, subject to applicable law. Before beginning formal proceedings, please contact us so we can try to resolve the issue. These Terms do not limit any mandatory rights or remedies available under applicable law.
